What is the process for a Family Petition?

The U.S. citizen or Lawful Permanent Resident family member is called the Petitioner and the non-citizen family member is called the Beneficiary. The Petitioner must file Form I-130, Petition for Alien Relative on behalf of their Beneficiary family member. The Family Petition must include evidence of the familial relationship.
If the Beneficiary resides within the United States, the Petitioner and Beneficiary may then be scheduled for an interview on the I-130 petition at your local U.S. Citizenship and Immigration Services (USCIS) office. In some cases, the Beneficiary may be considered an immediate relative and s/he may also simultaneously file her/his application for lawful permanent resident status. Immediate relative Beneficiaries will be scheduled for an interview with USCIS for both cases at the same time.
